1. Agreement to These Terms
These Terms of Service are an agreement between you and Money Badger LLC ("Money Badger," "we," "our," or "us"). By creating an account, accessing, or using Money Badger, you agree to these Terms and acknowledge the Privacy Notice.
If you do not agree, do not use the service. If you use Money Badger for an organization, you represent that you have authority to bind that organization.
2. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into these Terms. You must provide accurate information, keep your credentials and authentication methods secure, and promptly notify us of suspected unauthorized access.
You are responsible for activity under your account except to the extent caused by Money Badger's failure to meet an applicable legal obligation. Accounts may not be transferred without our permission.
3. The Service
Money Badger provides budgeting, financial organization, transaction review, importing, planning, forecasting, account-connectivity, and related tools. Features and availability may vary by plan, provider, financial institution, location, or product stage.
Money Badger is not a bank, lender, broker-dealer, investment adviser, tax adviser, accounting firm, credit-reporting agency, money transmitter, or financial institution. We do not hold or move your funds.
4. Alpha and Pre-Release Features
Money Badger may offer alpha, beta, preview, or experimental functionality. Such features may be incomplete, inaccurate, interrupted, changed, or removed. You should maintain independent copies of important records and review imported information, categorizations, budgets, forecasts, and calculations before relying on them.
5. No Financial, Legal, Tax, Investment, or Accounting Advice
Money Badger provides software tools and general information, not professional advice. Nothing in the service is financial, investment, legal, tax, accounting, lending, or credit advice or a recommendation to make a transaction.
You remain responsible for your decisions and should consult qualified professionals when appropriate.
6. Connected Services and Imports
You may direct Money Badger to connect with or import from third parties such as Plaid, Google Sheets, financial institutions, and file sources. You authorize us and those providers to access and process the information required to perform the actions you request.
- You must have the right to provide or authorize access to imported information.
- Third-party services are governed by their own terms and privacy notices.
- Connections, data availability, balances, and transaction details may be delayed, incomplete, duplicated, changed, or unavailable.
- Disconnecting a provider normally stops future access but does not automatically delete information already imported into Money Badger.
- You are responsible for reviewing imports and resolving duplicates, categories, transfers, refunds, and other interpretations.
7. Acceptable Use
You may not:
- Break the law or violate another person's rights
- Access or attempt to access another user's account, data, credentials, or integrations without authorization
- Probe, scan, exploit, disrupt, overload, or bypass security controls without Money Badger's prior written authorization
- Upload malware or use the service for fraud, abuse, harassment, or deceptive activity
- Scrape, copy, reverse engineer, resell, or commercially exploit the service except where applicable law expressly permits it
- Interfere with providers, rate limits, monitoring, billing, or the operation of the service
- Use automated means in a manner that creates unreasonable load or risk
Good-faith security research is permitted only within a scope and rules of engagement that Money Badger has expressly authorized in writing.
8. Your Content and License
You retain ownership of information you submit or authorize Money Badger to receive. You grant Money Badger a limited, non-exclusive license to host, process, reproduce, transmit, display, and otherwise use that information only as reasonably necessary to provide, secure, support, and improve the service; comply with your instructions; and meet legal obligations.
You represent that you have the rights and permissions necessary to provide the information and grant this license.
9. Paid Services and Automatic Renewal
Paid services are offered only when enabled and presented through an authorized Money Badger checkout or grant. Before purchase, checkout will identify the selected plan, price, billing interval, currency, and applicable recurring nature. If checkout describes a subscription as recurring, it automatically renews for successive billing periods until canceled, unless applicable law requires otherwise.
You authorize Money Badger and Stripe to charge the payment method associated with your Stripe customer account for disclosed subscription charges, applicable taxes, and other amounts you approve. Stripe, not Money Badger, receives and processes complete payment-card credentials.
Prices, features, and institution limits may change prospectively. We will provide notice of material subscription price changes as required by law. Promotions, complimentary access, and discounts may have separate eligibility, duration, and expiration terms.
10. Cancellation, Failed Payments, and Refunds
You may cancel an active subscription through available billing controls. Unless checkout or a cancellation confirmation states otherwise, cancellation takes effect at the end of the current paid billing period and paid access remains available through the displayed paid-through date.
Failed or overdue payments may result in retry attempts, a grace period, restricted paid features, or eventual suspension or cancellation. Ending paid access may stop future Plaid connections or synchronization, but it does not by itself delete previously imported transactions, budgets, categories, rules, or reports.
Refund eligibility and amounts depend on the applicable offer, payment evidence, prior refunds, disputes, use of the service, applicable law, and any policy shown before confirmation. Except where required by law or expressly stated at purchase, charges are not automatically refundable. Duplicate charges, confirmed billing errors, and discretionary or legally required refunds are reviewed using Stripe's authoritative payment records. Contact us before initiating a chargeback so we can try to resolve the issue.
11. Taxes
Prices may exclude taxes unless checkout states otherwise. You are responsible for taxes associated with your purchase, except taxes based on Money Badger's net income. When required and enabled, Stripe may calculate, collect, or record sales tax or similar transaction taxes using the billing information you provide.
12. Privacy and Security
Our Privacy Notice describes how we process personal information. You agree to use reasonable safeguards for your account. No service is completely secure, and you should promptly report suspected unauthorized access or vulnerabilities to us.
13. Intellectual Property
Money Badger and its licensors retain all rights in the service, software, designs, branding, documentation, and other materials excluding your content. These Terms grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the service in accordance with these Terms.
If you provide feedback or suggestions, you permit us to use them without restriction or compensation, but this does not give us ownership of your financial data.
14. Suspension and Termination
You may stop using Money Badger and may request account deletion through available tools. We may restrict, suspend, or terminate access when reasonably necessary to address a Terms violation, fraud, abuse, security risk, legal requirement, nonpayment, provider restriction, or threat to the service or others.
Where practical, we will provide notice and an opportunity to address the issue. Sections that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limitations, dispute terms, and retained-record obligations—remain effective.
15. Service Changes and Availability
We may modify, suspend, or discontinue features. We do not guarantee uninterrupted or error-free operation, provider availability, synchronization frequency, data completeness, or compatibility with every institution or file.
If Money Badger permanently discontinues a prepaid paid service, we will address unused prepaid service as required by applicable law and any policy presented at purchase.
16. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONEY BADGER IS PROVIDED "AS IS" AND "AS AVAILABLE." MONEY BADGER LLC DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that imported data, balances, categorizations, budgets, forecasts, reports, provider information, or calculations will be complete, current, accurate, secure, or error-free. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONEY BADGER LLC AND ITS MEMBERS, PERSONNEL, CONTRACTORS, AFFILIATES, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, FINANCIAL LOSSES, TAX CONSEQUENCES, OR INVESTMENT LOSSES ARISING FROM OR RELATED TO THE SERVICE.
Nothing in these Terms limits liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other matters where applicable law prohibits limitation. Because some jurisdictions restrict liability limitations, portions of this section may not apply to you.
18. Indemnification
To the extent permitted by law, you agree to defend and indemnify Money Badger LLC from third-party claims, damages, and reasonable costs arising from your unlawful use of the service, violation of these Terms, or infringement of another person's rights. This obligation does not apply to the extent a claim was caused by Money Badger.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules, except where the law where you live requires otherwise.
Before filing a formal claim, you and Money Badger agree to attempt in good faith to resolve the dispute by contacting the other party and allowing a reasonable opportunity to respond. These Terms do not require arbitration and do not waive rights that cannot lawfully be waived.
20. Changes to These Terms
We may update these Terms as the service, providers, or law changes. We will update the date above and provide additional notice of material changes when appropriate or required. Changes apply prospectively from their effective date. If you do not agree to updated Terms, you must stop using the service and cancel any subscription.
21. General Terms
These Terms and documents expressly incorporated into them are the agreement between you and Money Badger regarding the service. If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale of assets.
